Please read these terms carefully before using Oz Finance Hub. By using the site, you agree to be bound by these Terms of Service.
These Terms of Service ('Terms') govern your access to and use of the Oz Finance Hub website (ozfinancehub.com.au) and related services ('Service'). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. We may update these Terms from time to time; the 'Last updated' date at the bottom of this page indicates when they were last revised. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
Oz Finance Hub provides free Australian finance calculators (e.g. salary tax, HELP/HECS, super, mortgage, stamp duty) and optional Premium features (saved calculations, calculation history, income and dividend trackers, subscription). The Service is for general information and education only. It does not provide financial product advice, tax advice or personal advice. Our calculators give estimates based on the inputs and assumptions you provide and on rates and rules we believe to be current; results may differ from your actual outcomes. You must read and understand our Disclaimer before using the Service.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. The Service is intended for users in Australia; if you access it from elsewhere, you do so at your own risk and are responsible for compliance with local laws.
You may use the free calculators without creating an account. To use Premium features, you must create an account and provide accurate, current and complete information (e.g. email and password). You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must notify us promptly of any unauthorised use or breach of security. We may suspend or terminate your account if we reasonably believe you have breached these Terms or for operational or legal reasons.
Premium is a paid subscription that gives access to saved calculations, calculation history, income and dividend trackers, and other Premium features we describe on the site. Subscription fees, billing cycles and cancellation terms are set out on the Premium page and in any checkout or confirmation we provide. Payment is processed by Stripe; Stripe's terms and privacy policy apply to payment processing. We may change subscription fees or features on reasonable notice; continued use after a fee increase constitutes acceptance unless you cancel. Refunds and cancellation are set out in the 'Refunds and cancellation' section below.
You may cancel your Premium subscription at any time. Cancellation takes effect at the end of your current billing period; you retain access until then. We do not provide refunds for partial billing periods or unused time. If you believe you are entitled to a refund under Australian Consumer Law (e.g. the service was not as described or not fit for purpose), please contact us with your request and we will consider it in accordance with the law. Chargebacks and payment disputes should be raised with your card issuer; we will respond to any such requests with evidence of the service provided. For cancellation, use the link in your subscription confirmation email, the Premium area of the site, or Stripe's customer portal when we direct you there.
You must use the Service only for lawful purposes and in accordance with these Terms. You must not: use the Service in any way that violates Australian or other applicable law; attempt to gain unauthorised access to the Service, other accounts, or any systems or networks; use the Service to transmit malware, spam or other harmful or objectionable content; scrape, harvest or automate access to the Service in a way that burdens our systems or violates our robots.txt or similar; impersonate another person or entity; or use the Service to harass, abuse or harm others. We may suspend or terminate your access if we reasonably believe you have breached acceptable use.
You retain ownership of the data you submit to the Service (e.g. saved calculations, tracker entries). By submitting that data, you grant us a non-exclusive, royalty-free, worldwide licence to store, process and display it as necessary to provide and operate the Service (e.g. to show your saved calculations and trackers to you, to back up and secure the Service). We do not use your content for marketing or sell it to third parties. We may retain or delete your content in accordance with our Privacy Policy and these Terms (e.g. after account closure). You are responsible for ensuring that your content does not infringe any third party's rights or violate any law.
The Service (including the website, calculators, text, graphics, layout and software, but excluding your content) is owned by Oz Finance Hub or our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell or create derivative works from the Service (or any part of it) without our prior written consent, except as permitted by law (e.g. fair dealing for research or private study). You may view and use the Service for your personal, non-commercial use in accordance with these Terms.
The Service is provided 'as is' and 'as available'. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components. Our calculators and content are for general information and education only; they are not financial product advice, tax advice or personal advice. We do not hold an Australian Financial Services Licence (AFSL) and do not provide financial services. Calculator results are estimates only and may not reflect your actual outcomes. You must read our full Disclaimer (available on our website) for important information about your rights and our limitations. Nothing in these Terms excludes, restricts or modifies any guarantee or right you may have under the Australian Consumer Law or other law that cannot be excluded by agreement.
To the maximum extent permitted by applicable law (including the Australian Consumer Law): (1) we exclude all liability for any loss or damage (including indirect, consequential, special or incidental loss) arising from your use of or reliance on the Service, its content or calculator results; and (2) our total liability for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the 12 months before the claim (or, if you have not paid us, to A$100). Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded or limited under the Australian Consumer Law or other applicable law.
You agree to indemnify us (and our officers, employees and agents) against any loss, damage, cost or expense (including reasonable legal costs) that we incur arising from your breach of these Terms, your use of the Service, or your violation of any law or third party rights. This indemnity does not apply to the extent that the loss was caused by our negligence or wilful misconduct.
You may stop using the Service at any time and, if you have an account, you may close it (subject to any subscription cancellation process we describe). We may suspend or terminate your access to the Service or your account at any time, with or without notice, if we reasonably believe you have breached these Terms or for operational, legal or other reasons. On termination, your right to use the Service ceases. We may retain or delete your data in accordance with our Privacy Policy. Provisions that by their nature should survive termination (e.g. disclaimers, limitation of liability, governing law) will survive.
These Terms are governed by the laws of the State of New South Wales, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for the determination of any dispute arising out of or in connection with these Terms or the Service.
If you have a complaint or dispute about the Service or these Terms, please contact us first using the contact details published on our website. We will use reasonable efforts to resolve the matter within a reasonable time. If we cannot resolve it, you may pursue your rights under the governing law and jurisdiction clause above. Nothing in this clause prevents you from making a complaint to a regulator (e.g. the OAIC for privacy) or from seeking urgent relief from a court.
If any part of these Terms is held to be invalid or unenforceable, that part will be read down or severed to the minimum extent necessary, and the rest of the Terms will remain in force. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and us about the Service and supersede any prior agreements or understandings. We may assign our rights and obligations under these Terms; you may not assign yours without our prior written consent.
